Terms of Service

01Eligibility and your account

• You must be at least 18 years old to use Artquil.
• You must give accurate registration details and keep them current.
• You are responsible for everything that happens under your account, and for keeping your password and API keys confidential.
• Tell us promptly at hello@artquil.com if you believe your account has been compromised.

02Plans, credits and billing

• Artquil is offered on a free tier and on paid subscription plans. Current plans, prices and credit allowances are shown on our pricing page and form part of these terms.
• Paid plans may be offered with a 14-day free trial. The trial begins when you start it, runs for 14 consecutive days, and is limited to one per customer. Trial credits and features are those of the plan being trialled unless we state otherwise.
• You may cancel at any point during the trial and you will not be charged. If you do not cancel before the trial ends, the subscription begins automatically at the plan price then shown, and the first billing period starts on that date. We will email you before the trial ends.
• Generating a video consumes credits. Credits are reserved when a render is submitted and consumed when it completes.
• If a render fails because of a fault on our side, the reserved credits are returned to your balance.
• Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current period.
• Prices are in Indian Rupees and exclusive of applicable taxes unless stated otherwise. We may change prices with at least 30 days’ notice, effective from your next billing period.
• Unless your plan says otherwise, monthly credits do not carry over to the following period.

03Who owns what

Your inputs. You keep all rights in the prompts, images, audio and other material you upload. You confirm you have the rights necessary to use that material and to let us process it to produce your output.

Your outputs. Subject to your payment obligations and to the acceptable use rules below, you own the videos, audio and images Artquil generates for you, and on paid plans you may use them commercially, including in advertising and paid distribution.

Our platform. Artquil owns the platform, models, interfaces, documentation and brand. Nothing here transfers those to you.

Similar outputs. Generative models can produce similar results for different users given similar prompts. We cannot and do not guarantee that your output is unique, and we do not grant exclusivity over any generated result.

04Acceptable use

You may not use Artquil to create, upload or distribute content that:

• Depicts a real, identifiable person without their consent, including synthetic likeness, face swaps or voice cloning intended to deceive.
• Impersonates any person or organisation, or falsely suggests endorsement or affiliation.
• Is sexual content involving minors, or any sexual content involving a real person created without consent.
• Promotes violence, terrorism, self-harm, or hatred against a group on the basis of religion, caste, gender, sexual orientation, disability, race or ethnicity.
• Constitutes fraud, a scam, misleading political or electoral material, or misinformation likely to cause public harm.
• Infringes anyone’s copyright, trademark, publicity or privacy rights.
• Breaks any applicable Indian law, or the law of the place where you or your audience are located.

You also may not resell or redistribute raw access to the platform, attempt to reverse-engineer or extract our models, circumvent credit limits or rate limits, or use automated means to overload the service.

We may suspend or terminate accounts that breach these rules, and may remove offending content. Where we can, we will tell you why.

05The API

If you use the Artquil API, you must keep your keys secret, must not embed them in client-side code, and remain responsible for all usage on your keys. We may apply rate limits and may change the API with reasonable notice for breaking changes.

06Availability

We work to keep Artquil available and fast, but we do not guarantee uninterrupted service on free or standard paid plans. We may carry out maintenance, and we may change or discontinue features. Where a change is significant we will give notice. Specific uptime commitments apply only where agreed in a separate written enterprise agreement.

07Disclaimers

Artquil is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Generated output may contain errors or artefacts, and may not be suitable for every purpose. You are responsible for reviewing output before you publish or rely on it.

08Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or data.

Our total aggregate liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months immediately before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited under applicable law, including for fraud or wilful misconduct.

09Indemnity

You agree to indemnify and hold Artquil harmless against third-party claims arising from your inputs, your outputs, your use of the service, or your breach of these terms or of applicable law.

10Suspension and termination

You may close your account at any time. We may suspend or terminate your account for a material breach of these terms, for non-payment, or where required by law. On termination your right to use the service ends; provisions on ownership, disclaimers, liability, indemnity and governing law survive.

11Governing law and disputes

These terms are governed by the laws of India. The courts at Prayagraj, Uttar Pradesh have exclusive jurisdiction, and both parties submit to it.

Before starting proceedings, please contact us — most issues are resolved faster by email than by litigation.

12Changes to these terms

We may update these terms. For material changes we will give notice by email or in-product before they take effect. Continuing to use Artquil after that constitutes acceptance.
